1. Agreement to Terms
By accessing or using Proof Data ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
2. Description of Service
Proof Data provides a digital forensics and data acquisition platform that enables users to:
Acquire and preserve digital evidence with forensic integrity
Generate chain of custody documentation
Securely store encrypted copies of acquired data
Download and verify acquired data with cryptographic hashes
Manage acquisition records and metadata
3. Account Registration and Security
3.1 Account Creation
To use the Service, you must create an account by providing accurate and complete information. You may register using email/password or through Google OAuth / Microsoft authentication.
3.2 Account Security
You are responsible for:
Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access
Ensuring your account information remains accurate and up-to-date
3.3 Account Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to use this Service.
4. Acceptable Use Policy
4.1 Permitted Uses
You may use the Service only for lawful purposes, including:
Digital forensic investigations
Evidence preservation for legal proceedings
Compliance and audit requirements
Incident response and security investigations
Data backup and recovery with chain of custody
4.2 Prohibited Uses
You agree NOT to:
Acquire data without proper legal authorization or consent
Violate any applicable laws, regulations, or third-party rights
Upload malware, viruses, or malicious code
Attempt to gain unauthorized access to the Service or other users' accounts
Interfere with or disrupt the Service's operation
Reverse engineer, decompile, or disassemble the Service
Use the Service to store or transmit illegal content
Resell or redistribute the Service without authorization
Use automated systems to access the Service without permission
Circumvent security measures or authentication mechanisms
5. Payment and Subscription Terms
5.1 Pricing
Pricing varies by tier and are subject to change:
Free tier: Up to 1GB, 5 acquisitions per month
Quick Evidence: £49 per acquisition, up to 15GB
5.2 Payment Processing
Payments are processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for the services you purchase.
5.3 Refunds
If your acquisition fails due to a technical issue with Proof, it will be automatically retried. If retries fail, a full refund will be issued.
If your acquisition fails due to technical issues with the cloud provider, a refund may be issued at Proof's discretion.
Refunds for cancelled acquisitions will be considered at Proof's discretion.
Once an acquisition is complete and files are available for download, refunds are not available as the service has been delivered. This includes cases where files were not downloaded within the 60-day access window.

5.4 Taxes
You are responsible for any applicable taxes related to your use of the Service.
6. Data Ownership and Retention
6.1 Your Data
You retain all ownership rights to the data you acquire using the Service. We claim no intellectual property rights over your acquired data.
6.2 Data Retention
Acquired data is retained for 60 days from the acquisition date. After 60 days:
Encrypted data files are permanently deleted from our S3 storage
Metadata and chain of custody records may be retained for compliance purposes
You may request early deletion of your data at any time under Dashboard > Settings > Delete my Account, or by deleting the individual acquisition from the Dashboard.
6.3 Data Backup
While we implement regular backups, you are responsible for maintaining your own copies of critical data. We recommend downloading acquired data promptly.
7. Intellectual Property Rights
7.1 Service Ownership
The Service, including its software, design, features, and documentation, is owned by DeepTrace Consulting Limited and protected by copyright, trademark, and other intellectual property laws.
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose, subject to these Terms.
8. Chain of Custody and Evidence Integrity
8.1 Chain of Custody Documentation
We automatically generate chain of custody documentation for each acquisition, including cryptographic hashes (SHA-256, SHA-512, MD5) and timestamps. Chain of custody records are deleted with acquisition data after 60 days, unless required for an active legal proceeding or dispute involving Proof.
8.2 Verification
You are responsible for verifying the integrity of acquired data using the provided hash values and chain of custody records.
8.3 Legal Admissibility
While we follow forensic best practices, we make no guarantees regarding the legal admissibility of evidence in any jurisdiction. Consult legal counsel for guidance on evidence handling.
9. Service Availability and Support
9.1 Availability
We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.
9.2 Maintenance
We may perform scheduled maintenance with or without notice. We will attempt to minimize disruption during maintenance windows.
9.3 Support
Technical support is provided via email. We aim to respond within 48 business hours.
10. Disclaimers and Limitation of Liability
10.1 Service Provided "As Is"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
Warranties of merchantability or fitness for a particular purpose
Warranties of uninterrupted or error-free operation
Warranties regarding data accuracy or completeness
Warranties of legal admissibility of evidence
10.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEEPTRACE CONSULTING LTD SHALL NOT BE LIABLE FOR:
Indirect, incidental, consequential, or punitive damages
Loss of profits, data, or business opportunities
Costs of procurement of substitute services
Damages arising from unauthorized access to your data
Damages exceeding the amount you paid in the 12 months prior to the claim
10.3 User Responsibility
You are solely responsible for ensuring you have proper legal authorization to acquire and possess the data processed through the Service.
11. Indemnification
You agree to indemnify and hold harmless DeepTrace Consulting Ltd from any claims, damages, losses, or expenses (including legal fees) arising from:
Your use of the Service
Your violation of these Terms
Your violation of applicable laws or third-party rights
Unauthorized data acquisition or processing
Content you upload or process through the Service
12. Privacy and Data Protection
Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy. For users in the United Kingdom and European Economic Area (EEA), we process your data under UK GDPR and EU GDPR respectively.
13. Termination
13.1 Termination by You
You may terminate your account at any time by contacting us or using the account deletion feature. Upon termination, your acquired data will be deleted according to our retention policy.
13.2 Termination by Us
We may suspend or terminate your account immediately if you:
Violate these Terms
Engage in fraudulent or illegal activity
Fail to pay for services
Create security risks or harm other users
13.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. Data retention follows our standard 60-day policy unless you request immediate deletion.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.
15.2 Dispute Resolution
Any disputes arising from these Terms or the Service shall be resolved through good faith negotiation. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Proof Data regarding the Service.
16.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect.
16.3 Waiver
Our failure to enforce any provision does not constitute a waiver of that provision.
16.4 Assignment
You may not assign these Terms without our consent. We may assign these Terms without restriction.
16.5 Force Majeure
We are not liable for failures caused by events beyond our reasonable control, including natural disasters, acts of government, network failures, or cyberattacks.
